This User Agreement ("Agreement") is a legal contract between you ("The User") and xx, Lovestoned (“The Business”) regarding use of (“Materials”) which includes the Link + Learn™ in-person training (“Course”), Link + Learn™ digital / online course (“eCourse”), Permanent Jewelry 101 (“Workshop”), and any other digital products (“Digital Products”) offered by The Business. By purchasing, accessing, or participating in the Materials, you agree to comply with the terms and conditions set forth in this Agreement.
 
1. Payment:
   1.1. The User agrees to pay the applicable fees as specified by The Business. 
   1.2. Payment is due in full upon purchase unless The User is using payment installments. 
 
2. Obligations: 
   2.1. The User agrees not to share, resell, distribute, or duplicate any part of the Materials’ contents, including but not limited to login information, text, videos, audios, and downloadable resources, with any third party. 
   2.2. The User agrees not to reproduce, modify, adapt, translate, reverse engineer, decompile, or disassemble the Materials in any way. 
   2.3  The User agrees to maintain the confidentiality of all confidential information disclosed during the Materials, including but not limited to trade secrets, business strategies, proprietary methodologies, and personal information of other participants. 
   2.4  The User agrees that their success is dependent on their own efforts, capabilities, and diligence. 
   2.5  The User agrees that they have full capability and the appropriate means to participate in the Materials, including but not limited to transportation, a desktop computer, mobile device, high-speed internet, and English language fluency.
   2.6 The User agrees that they must be at least eighteen (18) years of age to use this website and the Materials. The User warrants that by purchasing, accessing, or participating in the Materials they are of legal age to consent to this Agreement. The Business assumes no responsibility or liability for any misrepresentation of The User’s age. 
   2.7. The User agrees to be responsible for checking their communication channels regularly for updates regarding Materials.   
 
3. Enrollment: 
   3.1. The User agrees that enrollment in the Course or Workshop is subject to availability and confirmation by The Business. 
   3.2. The User agrees to provide accurate and complete information such as contact details.
 
4. Schedule: 
   4.1. The Business reserves the right to reschedule the dates, times, or location of the Course or Workshop for any reason deemed necessary, including but not limited to circumstances beyond The Business’ control, such as inclement weather, natural disasters, facility closures, instructor availability, or unforeseen emergencies. 
   4.2. In the event of a Course or Workshop rescheduling, The Business shall make reasonable efforts to notify The User of any changes as soon as practicable. Notification may be provided via email, telephone, text message, or other communication channels specified by The Business. 
   4.3. The Business shall not be liable for any inconvenience, loss, expense, or damage incurred by The User as a result of course rescheduling, and The User shall not be entitled to any refunds, compensation, or damages for such changes.   
 
5. Attendance and Participation: 
   5.1. The User agrees to attend all scheduled sessions of the Course or Workshop and actively participate in class activities and discussions. 
   5.2. The User agrees that active participation is essential for successful completion of the Course or Workshop. 
 
6. Conduct: 
   6.1. The User agrees to conduct themselves in a professional and respectful manner at all times during the Materials. 
   6.2. The User agrees not to engage in any disruptive or inappropriate behavior that may interfere with the learning experience of other participants.   
 
7. Online Access: 
   7.1.  The User acknowledges and agrees that if purchasing the in-person Course, their version of the eCourse will not be available until completion of their in-person Course as opposed to Users who purchase only the eCourse in which those particular Users get immediate access to (with the exception of those who purchased prior to its release).
   7.2. The User is granted access to the eCourse for a "lifetime" period for as long as the eCourse is actively sold by The Business or for as long as The Business is operational ("Access Period”).
 
8. Intellectual Property Rights: 
   8.1. All intellectual property rights in the Materials, including but not limited to copyrights, trademarks, trade secrets, and patents, are owned by The Business or its licensors. 
   8.2. The User acknowledges that the Materials’ contents are protected by copyright laws and international treaty provisions. 
   8.3. No license or right is granted to The User except as expressly set forth in this Agreement.   
 
9. Service Interruptions: 
   9.1. The Business reserves the right to interrupt your access to the eCourse or Digital Products to perform maintenance or emergency services on a scheduled or unscheduled basis. The User agrees that access to the eCourse, Digital Products, and/or website may be affected by unanticipated or unscheduled downtime, for any reason, but that The Business shall have no liability for any damage or loss caused as a result of such downtime. 
 
10. Termination: 
   10.1. The Business reserves the right to terminate The User's access to the Materials if The User breaches any provision of this Agreement. 
   10.2. Upon termination, The User must cease all use of the Materials’ contents and destroy any copies thereof in their possession.
   10.3. The User understands that The Business may take legal action against The User in regard to any violations of this agreement especially copyright infringement.
 
11. No Refunds: 
   11.1. All sales of the Materials are final and non-refundable. 
   11.2. The Business does not provide refunds for any reason, including but not limited to dissatisfaction with the content, change of mind, or inability to access or participate in the Materials. 
 
12. Limitation of Liability: 
   12.1. The User acknowledges that participation in the Course or Workshop may involve certain risks and agrees to assume full responsibility for their own safety and well-being. 
   12.2. In no event shall The Business be liable for any lack of success, failure to achieve desired results, or inability to meet specific goals or expectations following the completion of the Materials. 
   12.3. In no event shall The Business be liable for any indirect, incidental, special, consequential, or punitive damages, injury, or loss arising out of or related to the use or participation of the Materials. 
   12.4. The Business's total liability under this Agreement shall not exceed the amount paid by the The User for the Materials.   
 
13. Governing Law and Jurisdiction: 
   13.1. This Agreement shall be governed by and construed in accordance with the laws of California. 
   13.2. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Los Angeles, California. 
 
14. Entire Agreement: 
   14.1. This Agreement constitutes the entire agreement between The User and The Business regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and communications, whether written or oral. 
 
By purchasing, accessing, or participating in the Materials, The User acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Agreement.
